Terms of sale

1. Service provider

VTC Elbeuf is operated by Abdoulaye Konté, sole trader (Entreprise Individuelle), SIRET 940 501 497 00017, VTC professional card no. 07625006602, 26 rue François Raspail, 76410 Saint-Aubin-lès-Elbeuf, France. Telephone: 07 59 29 69 79. Email: abdou.vtc76@gmail.com. The business is private hire passenger transport with a driver (VTC), carried out in accordance with the applicable regulations.

2. Purpose and services

These terms of sale apply to every booking with VTC Elbeuf, whatever the way of booking: the website simulator, WhatsApp or telephone. Booking means accepting these terms.

The services offered are: rides (one way, round trip, stations, airports), chauffeur on call , rides for weddings, evenings and events, children's rides, rides to medical appointments (non-reimbursed) and the 9-seat van. The usual vehicle carries up to 4 passengers.

3. Booking

Booking is done through the fare simulator, by WhatsApp or by telephone. It is firm once the driver has confirmed it, by message or call. The customer gives accurate information: addresses, date and time, number of passengers, luggage and, for an airport or station transfer, the flight or train number.

The simulator does not allow booking a ride that starts in less than 2 hours. In that case the customer contacts the driver directly on WhatsApp, who replies depending on availability. The 9-seat van must be booked at least 72 hours in advance.

As the services are provided on a specific date and at a specific time, and as this is a passenger transport contract, the 14-day withdrawal period does not apply. The cancellation terms in article 6 apply.

4. Fares

All prices are in euros including VAT. The simulator estimate is indicative and the fare is confirmed before booking. Once confirmed by the driver, the fare is firm, unless the customer asks for a change (route, time, extra stop, number of passengers).

Fixed zone fare: €15 including VAT one way and €25 including VAT round trip for rides booked with the simulator where both pickup and drop-off are within 10 km of Elbeuf. For other rides, the fare depends on distance, time (day 8am to 8pm, night 8:01pm to 7:59am) and date (Sundays and public holidays). Two surcharges may apply, shown in the simulator: a pickup surcharge of €1 per km for the distance driven empty beyond 10 km from Saint-Aubin-lès-Elbeuf to the pickup point, and a 15% peak-hours surcharge (Monday to Friday, excluding public holidays, 7am to 9am and 4:30pm to 7pm). Airport transfers: fixed daytime fare (8am-8pm) for rides between the airport and Elbeuf or its 10 km area, i.e. €190 including VAT to CDG or Orly and €130 including VAT to Beauvais for up to 4 people, €240 including VAT to CDG or Orly and €180 including VAT to Beauvais for 5 to 9 people (9-seat van). These fares are higher at night, on Sundays and on public holidays in the same proportions as the per-kilometre scale, and the round trip is calculated with the same coefficient; the exact amount is shown in the simulator. For a pickup point outside this area, the pickup surcharge above applies in addition.

Chauffeur on call: 3 hours minimum, 150 km included, €300 including VAT by day, €320 including VAT at night, €340 including VAT on Sundays and public holidays by day, €355 including VAT on Sundays and public holidays at night. After 3 hours, each extra hour is charged pro rata. Beyond 150 km, a supplement is quoted before booking.

Any additional cost (tolls, parking) is indicated to the customer before the booking is confirmed.

5. Payment and invoice

Payment is made by card, in cash or, for businesses, by bank transfer. It is due at the end of the ride, unless agreed otherwise. For any booking made through the website simulator, a 30% deposit of the estimated price is requested at confirmation, by instant transfer (Wero) or another method indicated by the driver; the ride is confirmed once the deposit is received. It is deducted from the final price and refunded in case of free cancellation (article 6). For services on quote (wedding, event, van, long chauffeur-on-call booking), a deposit may also be requested; its amount is shown on the quote. An invoice is provided on request.

6. Cancellation and changes

If the driver is unable to carry out the ride, they inform the customer as soon as possible and try to offer a solution. No payment is then due.

7. Delays and waiting

For an airport or station transfer, the driver tracks the flight or train and adjusts the pickup time. Extra waiting beyond the time announced when booking may be charged pro rata, after informing the customer. The driver does their best to be on time; they cannot be held responsible for a delay caused by an unforeseeable event (exceptional traffic, bad weather, accident, strike, roadworks). Allowing a margin for a connection is advisable.

8. Customer obligations

9. Minor passengers

A minor travelling without a parent is carried subject to a written authorisation from a parent or legal guardian, sent before the ride, and to the driver's confirmation, after being told the child's age and maturity. A seat or booster suited to the child's age is compulsory up to age 10. The child is handed over only to the person named by the parent. During the ride, the parent can follow the vehicle's position live and call the driver; tracking is limited to GPS position, with no listening in or audio recording.

10. Medical appointments (non-reimbursed transport)

Rides to a medical appointment are VTC rides. They are not medical transport (ambulance, VSL, reimbursed taxi), are not covered by the national health insurance and include no medical assistance. The passenger must be able to get into the vehicle, sit and get out; carrying a person lying down or in a wheelchair is not possible.

11. Liability and insurance

The vehicle is insured for the paid carriage of passengers. The driver is liable for damage within the limits set by law. They are not liable for forgotten items or undeclared valuables left in the vehicle, unless at fault.

12. Personal data

The data supplied for a booking (name, telephone, email, addresses) is used only to process the request and contact the customer. Rights of access, rectification and deletion, and the third-party tools used, are detailed in the legal notice.

13. Complaints and mediation

For any complaint, the customer writes to abdou.vtc76@gmail.com, stating the date and ride concerned. VTC Elbeuf replies as soon as possible. If no agreement is reached, a consumer customer may use a consumer mediator free of charge.

14. Governing law

These terms are governed by French law. The competent courts are determined according to the applicable legal rules.
